53 year old Lisa Vargas makes a court appearance in Banning on Weds May 26th facing a murder charge in the killing of 33 year old David Spann in his home on the northwest side of Palm Springs back in April.

Vargas is the mother of 36 year old Fabian Herrera who actually shot and killed Spann.

Spann lunged at Herrera with a knife after Herrera tried to break into Spann’s home, claiming to be a bail agent, and claiming Spann was  a fugitive.

Turns out Herrera did not have a bail agent license, and Spann was not wanted by any law enforcement agency in the area.

Herrera is also a felon and was not legally allowed to even have a gun. He has already pleaded not guilty to a murder charge.

Vargas is charged with murder and  with delivering the gun to Herrera.

Vargas was captured in Whittier a few weeks after Spann was shot and killed.

She was suffering from self-inflicted injuries when police arrested her.

As for Palm Springs Police, they were at the scene when the shooting occurred, and used a taser on Spann, but to no avail.  Police did not fire their guns in this incident.
