It has taken 8 years, but the long legal battle is over for Imperial Irrigation District.
At question was whether the District had the legal right to distribute water to Imperial Valley farmers so they can use it to grow food.
What might seem like a simple question and answer was clouded by a legal challenge from a man named Michael Abatti as he questioned IID’s right to access the water, and the farmers’ use of that water.
In July of 2020, the Fourth District Court of Appeals ruled that agricultural water users in IID territory, do have an equitable and beneficial interest in the district’s water rights, and are entitled to get water from the IID.
The legal challenge to that ruling made it to the United States Supreme Court, which has just decided not to take up the case.
So the Appeals Court ruling stands.
The legal fight is over.
